1. PACT Act Compliance

As part of federal law, Vape Night complies with the Prevent All Cigarette Trafficking (PACT) Act. This requires us to:

  • Verify the age (21+) and identity of customers through third-party verification systems.
  • Collect and remit applicable excise and sales taxes.
  • Register with and report shipments to state tobacco tax administrators where required.
  • Use shipping carriers that require an adult signature (21+) at delivery.

2. State and Local Law Compliance

It is the customer’s responsibility to understand and follow all applicable state and local laws governing the purchase, possession, and use of vape products. Vape Night strictly adheres to these regulations and does not ship to states or cities where vape products are restricted or banned.

States Where Vape Products Are Restricted or Banned

  • California: Flavored vaping products, including menthol and dessert flavors, are banned statewide.
  • Massachusetts: Comprehensive ban on flavored vaping products and certain high-nicotine e-liquids.
  • New York: Flavored e-cigarettes are banned, including fruit, menthol, and dessert flavors.
  • Rhode Island: Ban on all flavored e-cigarette products.
  • Washington, D.C.: Flavored e-cigarettes, including menthol, are prohibited.
  • New Jersey: Statewide ban on flavored vaping products, including menthol and tobacco alternatives.
  • Oregon: Restrictions on flavored vaping products, depending on local jurisdictions.
  • Utah: Sale of flavored vape products is restricted to specialty tobacco shops.

Cities and Counties with Additional Restrictions

  • San Francisco, CA: Comprehensive ban on the sale of all e-cigarettes.
  • Beverly Hills, CA: Complete ban on the sale of tobacco and vape products.
  • Chicago, IL: Ban on flavored vape products, including menthol, within city limits.
  • Minneapolis, MN: Ban on flavored vaping products in the city.
  • Lansing, MI: Restrictions on flavored e-cigarettes and nicotine delivery systems.
  • Anchorage, AK: Certain restrictions on the sale of flavored vape products.

Note: This list is updated regularly based on changes to state and local laws. Customers should review their local regulations before placing an order.

3. Shipping Locations

  • Vape Night ships to most U.S. states where the sale of vaping products is legal.
  • We do not ship internationally at this time.

4. Shipping Requirements

  • Adult Signature Required: An individual aged 21+ must present a valid government-issued ID to receive the shipment.
  • Accurate Address Information: Customers must provide complete and accurate shipping information. Vape Night is not responsible for delays caused by incorrect addresses.

5. Restricted Products

Certain products are subject to additional shipping restrictions due to state and local laws. Vape Night reserves the right to cancel or restrict shipments that violate applicable regulations.

6. Lost, Stolen, or Damaged Packages

If your package is lost or damaged during transit:

  • Notify us immediately at support@vapenight.com.
  • Vape Night is not liable for packages marked as "Delivered" by the carrier but reported missing by the customer.
